Trademark registration in India, from clearance to enforcement.

PRASA IP assists businesses, founders and brand owners with trademark searches, applications, objections, oppositions, renewals and coordinated international protection.

Trademark search and clearance

A trademark search helps identify earlier marks that may affect adoption or registration of a proposed name, logo or other brand identifier. The scope may include exact, phonetic and conceptually similar marks in relevant classes, together with an assessment of the goods or services and the overall commercial context.

Trademark applications in India

Application support includes ownership review, identification of the mark, selection of appropriate classes, drafting the specification of goods and services, user-claim documentation and filing before the Trade Marks Registry. Applications are filed online, and the Registry operates from Mumbai, Delhi, Kolkata, Chennai and Ahmedabad, so we act for brand owners anywhere in India. Care at the filing stage can reduce avoidable inconsistencies later in prosecution.

Typical trademark services

  • Pre-filing searches and registrability review
  • Word-mark and logo applications
  • Classification of goods and services
  • Examination-report and show-cause-hearing responses
  • Opposition and counterstatement support
  • Renewal, assignment and portfolio recordal
  • International filing coordination

Trademark objections and hearings

Where the Registry raises absolute or relative grounds, we review the cited marks and objections, the client’s use and supporting evidence, and develop an appropriate written response. Hearing preparation may include review of the prosecution history, legal authorities, evidence of use and proposed limitations where commercially appropriate.

Trademark opposition and enforcement support

Opposition proceedings require careful assessment of priority, similarity, goods and services, consumer context and available evidence. We assist with opposition strategy, pleadings, evidence coordination and related brand-protection steps. Enforcement advice is tailored to the nature of the use, urgency, commercial relationship and available remedies.

International trademark coordination

For clients expanding outside India, we assist with market prioritisation and coordinate filings through suitable national or international routes and qualified local counsel. The appropriate route depends on the target jurisdictions, ownership structure, brand use and commercial timetable. India is a member of the Madrid Protocol, so one international application can extend an Indian mark to the United States, the European Union and other members. National filings remain the better choice in some markets.

Questions before filing a trademark in India

Should the brand name be searched before an application?

A search can reveal identical or similar marks and help assess filing choices before the brand is launched. It does not guarantee that the Registry will accept an application or that a third party will not object. We discuss the proposed mark, goods and services, use history and intended markets before defining the search scope.

What if the Trade Marks Registry objects?

The response depends on the ground raised. We review the examination report, cited marks, underlying goods or services and available use evidence before preparing the written response or hearing strategy. An objection from the Registry is distinct from an opposition filed by another party.

Our team in Bengaluru also supports patents, copyright and designs where a business needs coordinated protection.

Trademark portfolio management

Portfolio support includes status reporting, renewal monitoring, ownership changes, review of class coverage and alignment between registrations and current commercial use. This is particularly useful where products, services or geographic markets have expanded since the original filing.
